Terms of Service

Welcome to KEN VPN. By creating an account or using our service, you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using the KEN VPN application, website at kensecure.com, or any related services (collectively, "the Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

KEN VPN provides a virtual private network (VPN) service that encrypts your internet connection using the WireGuard protocol. The Service is available through our mobile application for Android (and in the future, iOS). We offer both free and paid subscription tiers with varying levels of features, bandwidth, and server access.

3. Account Registration

To use KEN VPN, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your password and account
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

You must be at least 16 years of age to create an account. We reserve the right to refuse service, terminate accounts, or remove content at our discretion.

4. Subscription Plans & Billing

4.1 Free Tier

The Explorer (free) plan provides limited access to the Service including 1 device, 500 MB monthly bandwidth, and access to standard servers. No payment information is required.

4.2 Paid Plans

Paid plans (Shield, Fortress, Citadel) are billed monthly through Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis. Prices are displayed in GBP and are inclusive of applicable taxes.

4.3 Cancellation

You may cancel your subscription at any time from the Account screen in the App or through the Stripe billing portal. Upon cancellation, your paid features will remain active until the end of the current billing period. After that, your account will revert to the free tier.

4.4 Refunds

Refund requests are handled on a case-by-case basis. If you are unsatisfied with the Service within the first 7 days of a new subscription, contact us at support@kensecure.com to request a refund.

5. Acceptable Use

You agree to use KEN VPN only for lawful purposes. You may not use the Service to:

• Engage in any illegal activity under UK law or the laws of your jurisdiction
• Distribute malware, viruses, or other harmful software
• Send spam, phishing emails, or engage in fraud
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorised access to systems, networks, or accounts
• Engage in any activity that could damage, disable, or impair our infrastructure
• Share your account credentials with others or allow multiple people to use a single account
• Circumvent or attempt to circumvent plan limits through technical means

6. Device Limits

Each subscription tier includes a maximum number of simultaneously registered devices. If you exceed your device limit, you will need to deactivate an existing device before registering a new one. Device limits are as follows: Explorer (1), Shield (3), Fortress (6), Citadel (10).

7. Bandwidth Limits

Free and Shield plans include monthly bandwidth limits. Bandwidth usage resets on your billing cycle date. If you exceed your bandwidth limit, VPN connectivity will be paused until the next reset or until you upgrade to a higher tier. Fortress and Citadel plans include unlimited bandwidth.

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned maintenance.

9. Intellectual Property

The KEN VPN application, website, branding, and all associated content are owned by KEN Secure Ltd and protected by copyright and trademark law. You may not copy, modify, distribute, or create derivative works from our materials without prior written consent.

10. Limitation of Liability

To the maximum extent permitted by law:

• KEN VPN is provided "as is" without warranties of any kind, express or implied
• We do not warrant that the Service will be error-free, secure, or available at all times
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim

11. Indemnification

You agree to indemnify and hold harmless KEN Secure Ltd, its officers, directors, and employees from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Termination

We may suspend or terminate your account if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and intellectual property) shall survive.

13. Changes to These Terms

We may modify these Terms at any time. We will provide notice of material changes via email or in-app notification at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

14. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
